Who Is Eligible for Protection Orders in Knox?

Victims of domestic violence who can seek Protection Orders can include:

  • Current and former spouses
  • Current and former dating/sexual partners
  • Those who live together or have formerly lived together
  • Those who are related by marriage, blood, or adoption
  • Children of any of the above

    Types of Protection Orders & What They Can Do

    Temporary Protection Orders (TPOs) can be issued by a judge on a short-term emergency basis. These do not require immediate notification nor the presence of the abuser by the court to do so. They last for 15 days or until a hearing is scheduled in which both parties can appear in court. The hearing will determine whether the TPO should be extended. 

    In the scheduled court hearing, the judge will hear evidence from both sides to decide if an Extended Protection Order (EPO) should be issued. If an EPO is ordered, it typically lasts for a year after which it may be further extended in one-year periods. These Protection Orders can be issued for a lifetime in cases where the offender was convicted of a felony against you, such as for assault. 

    Protection Orders are legal orders and restrictions placed upon the abuser. They can do the following:

    • Order the abuser to stop all actions of abuse, stalking, sexual assault, etc., or threats of such actions against you
    • Order the abuser to stop all communications with you, whether by phone, text, email, letter, etc.
    • Order the abuser to stay away from your home, workplace, or other places you habitually frequent
    • Order temporary custody/visitation rights of the children you share
    • Order the abuser to vacate the shared home
    • Order the offender to provide you with financial support 
    • Order the offender to attend counseling
    • Bar the offender from possessing a gun
    • Anything else the court deems appropriate
